Livelisteners (the “Company”, “Livelisteners.com”, the “Platform”, "we", "us" and "our") enables its Users (the “User(s)”, “you” or “your”) to communicate with a Therapist, consultant, practitioner, professional adviser or any other person (collectively the "Therapist") for the purpose of getting counselling, information, advice or any other input, benefit or service (collectively the "Therapist Services"), as well as with a Confidant, a non-professional adviser, or any other person (collectively the “Confidant”) for the purpose of getting listened to, advised, counselled in an non-professional manner or getting any other input, benefit or service (collectively the "Confidant Services”).

Livelisteners is deeply committed to safeguard the privacy expectations of its Users. Accordingly, we have put in place this Privacy Policy, which outlines our data protection practices, including how we collect, use, disclose and store your Personal Information (the “Personal Information”) you make available to us through the Platform tools to provide the services described above (collectively, the "Services"). Because we want you to use our site in a peaceful and trustworthy way, please be assured that we are fully dedicated to the protection of the information we get from you. Accordingly, we have put in place this Privacy Policy, which outlines our data protection practices, including how we collect, use, disclose and store your Personal Information.

We encourage you to read the Privacy Policy carefully and use it to make informed decisions. By visiting the Company’s Platform or by creating an account through our Services, you hereby agree to the Privacy Policy.

1. WHO CAN USE OUR SERVICES

The Services are not designed or directed to persons under the age of 18 or persons under the age of legal consent with respect to the use of the Services of any jurisdiction, whichever is higher (“Legally of Age”). If you are not Legally of Age, you should not use the Services nor provide any Personal Information to us.

We reserve the right to access and verify any Personal Information collected from you. If we become aware that a User who is not Legally of Age has shared any information, we may discard such information. If you have any reason to believe that a minor has shared any information with us, please contact us at DPO@livelisteners.com.

2. WHAT INFORMATION WE COLLECT

Livelisteners is a data controller regarding any Personal Information collected from Users of its Service. A "data controller" is an entity that determines the purposes for which and the way any personal information is processed. Any third parties that handle your Personal Information in accordance with our instructions are our service providers and are "data processors".

We collect two types of information from our Users and from visitors of our Services:

2.1. Personal Information

The first type of information is the one that identifies or may identify an individual without a reasonable effort, named “Personal Information”. The personal data which is being gathered may consist of the following:

2.1.1. Registration details: When you open an account and register to use the Services, you will be asked to provide us with certain details about yourself.

If you register as User, you must provide the following information:

  • Screen Name
  • Email

2.1.2. Voluntary information: We also collect information which you provide us voluntarily. For example, you can provide your image, gender, location, and additional information about you. Furthermore, we collect your information when you respond to communications from us, communicate with us via email or internal message system, or share additional information about yourself through your use of the Services, such as on the chat feature.

2.1.3. Usage information: We collect information about your activity on our Platform and about how you interact with our features. Precisely, we know your activity history on our Platform, the time you spend in paid sessions, the type of communication with our Listeners (OpenTalk or PrivateTalk Sessions, Messages), etc.

2.1.4. Content Information: For technical purposes, we store the content you create and/or post and/or transmit on/via our Platform (for example pictures) and information about the content you create or provide.

2.1.5. Log data and device information: We automatically collect log data and information from or about your computer, phone, or other device you use to access or navigate on our Platform. This includes:

  • your IP address.
  • the date and time you logged in.
  • pages viewed.
  • types of features you use.
  • the hardware, software, or internet browser you use.
  • information about your computer’s operating system.
  • identifiers associated with cookies or other technologies that may uniquely identify your device or browser.

If you are using a mobile device, we might also collect:

  • data that identifies your mobile device.
  • device-specific settings and characteristics.
  • location details.
  • app crashes and other system activity.

2.1.6. Customer Support requests: If you need technical support related to our Services, you will need to complete a form for the purposes of defining and clarifying your technical support request. When submitting a technical support request, you will be asked to provide Personal Information, including an email address and a description of the issue. We maintain copies of all technical support requests and other information submitted with or related to such requests, also for training and/or security purposes.

2.1.7. Information we collect from third parties: We sometimes collect Personal Information from third party service providers, such as information which is gathered to verify your identity and prevent fraudulent or illegal activity.

2.2. Non-personal Information

The second type of information is un-identified and non-identifiable information pertaining to a User(s), which may be made available or gathered via the User’s use of the Services (the “Non-Personal Information”).

Non-Personal Information which is being collected consists of technical information and aggregated usage information, and may contain, among other things, the User’s operating system, type of browser, screen resolution, browser and keyboard language, the User’s ‘click-stream’ and activities on the Services, the period the User visited the Services and related time stamps, etc.

Types of Non-personal Information we collect from or about you:

2.2.1. Technical information: To enhance the functionality of the Services and to provide you with a better user experience, we collect technical information transmitted by your device, including certain software and hardware information (e.g., the type of browser and operating system your device uses, language preference, access time and the domain name of the website from which you linked to the Services; etc.).

2.2.2. Analytics information: We collect information about your use of the Services, such as applications' usage, log files, user activity (e.g., pages viewed, the amount of time spent on pages, online browsing, clicks, actions, etc.), time stamps, alerts, etc. This information is collected for amongst other things troubleshooting errors and bugs as well as for research and analytics purposes about your use of the Services.

2.2.3. Anonymous information: We may anonymize or de-identify the information collected by the Services or via other means so that the information cannot, on its own, personally identify you. Our use and disclosure of such aggregated or de-identified information is not subject to any restrictions under this Privacy Policy, and we may disclose it to others without limitation and for any purpose, such as for advertising or marketing purposes.

3. HOW WE USE THE COLLECTED INFORMATION

We use your Personal Information for the purposes listed below:

  • To set up, manage and update your account.
  • To provide and operate the Services (such as for payment processing).
  • To communicate with you and to keep you informed of our latest updates to our Services.
  • To conduct analytics, statistical and research purposes, to improve and customize the Services to your needs and interests (such as by compiling aggregated reports about the usage of certain features of our Services).
  • For Customer Support Department purposes, and to support and troubleshoot the Services and to respond to your queries.
  • To enable us to further develop, customize and improve the Services based on Users’ common preferences and uses.
  • To communicate with your and to process any of your requests to exercise your User rights.
  • To identify and authenticate your access to certain features of the Services.
  • To detect and prevent fraudulent and illegal activity or any other type of activity that may jeopardize or negatively affect the integrity of the Services, including by identifying risks associated with your activity on our Services.
  • To investigate and resolve disputes in connection with your use of the Services; and as required by law or regulation (such as Know Your Customer ("KYC") and Anti-Money Laundering regulatory requirements), or as required by other governmental authorities, or to comply with a subpoena or similar legal process or respond to a government request.

4. WHY DO WE PROCESS YOUR INFORMATION

We use the information we collect for the following purposes:

4.1. Open your User account and allow you to offer services

First and foremost, we use the Personal Information you give us at the creation of your account to open and administer your online account and allow you to do several activities on our Platform, notably to access the Therapist or Confidant Services, as agreed upon the Terms and Conditions. Your account is also a way to exercise control over your Personal Information, of the content you wish to share with us or with the Therapists and Confidants.

We process this information to perform the contract that we have with you, precisely to allow you to access the Therapist or Confidant Services. If you fail to provide minimum details about you, the consequence will be that we will not be able to create your account and/or allow you to access the services on our Platform.

4.2. Improve and promote our services

We use your Personal Information for statistical and analytical purposes. We also use your Personal Information for testing purposes, troubleshooting, and improving the functionality and quality of our Services.

We process this information given our legitimate interest in developing and improving our Platform and our Users’ experience, as well as to promote Therapists and Confidant Services.

4.3. Relationship management and communication with you

We provide Customer Support service 24 hours a day, 7 days a week. Sharing your personal details with our Customer Support Department allows us to respond to any question you might have about our services. All your communications with our Customer Support Department and all information you provide during such communications, including any review or opinion about a Listener are collected and analysed so that we may respond to your request. Finally, be aware that, when receiving a request or claim from you, our Customer Support Department can access all information you give to us and all information we collected about you within the course of your use of the Platform. We want to make sure that our Customer Support Department has all the information needed to appropriately and immediately respond to your request, but also to be able to detect any fraudulent activity.

Please note that we may also communicate with you through emails or any other means, if appropriate, to inform you of certain changes regarding our Platform or of certain events, for example, when you successfully register on our Platform.

The use of your personal information is necessary to perform the contract that you have with us, notably to deliver appropriate Customer Support services to you.

4.4. Ensure a safe and trustworthy environment

Because we want to create and ensure a safe environment where you can peacefully use our Platform and access the Therapist and Listener Services, we use your Personal Information to detect and prevent fraud and other illegal activities on our Platform. We also use your data to detect potential breaches to the rules of our Platform.

Finally, we use your Personal Information for security purposes and risk assessment, such as to authenticate you on our Platform, verify your identity, and ensure that you are above the age of majority in your country.

We process this information given our legitimate interest in ensuring compliance with the rules of our Platform, fraud detection and prevention, as well as information, system, network, and cyber security.

4.5. Sending of messages and marketing e-mails

We will send you marketing emails, which could be tailored to your characteristics (such as your country). We also use your e-mail address to send you invitations to participate in our surveys to understand your opinion about our business and/or brand or otherwise with the aim to improve our services.

The sending of messages and marketing emails is based on our legitimate interest.

Be aware that you can very easily revoke your consent to receive such emails at any time.

We may pseudonymize your email address and use it to generate statistical results. Such statistics are in the form of aggregated data and not personal information (for example, number of Users per country who are registered on our Platform).

4.6. Comply with any legal requirements and enforce our legal rights

We may rely on a legal obligation to process your Personal Information, such as for accounting purposes, to respond to requests of competent authorities or to establish, exercise or defend legal claims. We may combine your information with information lawfully obtained from other third-party sources and use it for such purposes.

5. WITH WHOM WE SHARE INFORMATION

We do not rent, sell, or share your Personal Information with third parties except as described in this Privacy Policy. The Personal Information will be disclosed to third parties only to the extent required for the specific purpose, as stipulated in this Privacy Policy.

We share Personal Information with any of the following third parties:

  • Companies within the Company and other affiliated companies.
  • Subcontractors and third-party service providers, as well as their subcontractors, which by way of example include (but is not limited to) cloud computing companies, marketing affiliates, identity verification and fraud prevention services, and other data verifiers.
  • Payment service providers, payment processors and banks.
  • To any third parties who provide services in relation to the operation or promotion of the Services.
  • Auditors, contractors, or advisers of any of the Company’s business processes.
  • To any third parties who investigate, detect or prevent fraudulent or illegal activity (e.g., governmental authorities, police, banks and other investigatory organizations);
  • Governmental and regulatory bodies, in accordance with applicable laws and regulations;
  • Potential purchasers or investors in any of the companies within the Company or While Label Brand (if applicable), or in the event of a corporate transaction (e.g., sale of a substantial part of our business, merger, reorganization, bankruptcy, consolidation or asset sale of an asset or transfer in the operation thereof) in relation to any company within the Company (in such event, the acquiring company or transferee will assume the rights and obligations as described in this Privacy Policy).

In addition to the purposes listed in this Privacy Policy, we share Personal Information with those Recipients for any of the following purposes:

  • Storing such information on our behalf, for example by using cloud computing service providers.
  • Processing such information to assist us with our business operations (e.g., to process payments and your deposits; authenticate your access; auditing our operations; detect and prevent fraudulent or illegal activity; etc.).
  • Performing research, technical diagnostics, or analytics.
  • Communicating targeted advertising, as well as promotional and informational materials, in accordance with our marketing policy;
  • Whenever we believe in good faith that disclosure is necessary to protect our rights or legal claims, enforce our policies, protect your safety or the safety of others, as well as to investigate or prevent any fraud, for security reasons or to help us with any other related technical issue.

6. THIRD-PARTY SERVICES

While using the Services you may encounter links to third-party websites, services, or applications. Please keep in mind that this Privacy Policy does not apply to any third-party websites, services, or applications, even if they are accessible, downloadable, or otherwise distributed through the Services.

For example, when making a payment by credit card our third-party billers (and not Livelisteners.com) collect your credit card information and other information necessary for processing / authorizing your credit card payments. These payment companies may also provide certain of your details to us.

Please be advised that such third-party websites, services, or applications are independent from the Company. We assume no responsibility or liability whatsoever regarding privacy matters or any other legal matter with respect to such third-party websites and/or services. We encourage you to carefully read the privacy policies and the terms of use of such third-party websites and/or services, as their terms, not ours, will apply to any of your interactions with such third parties.

You should always review their privacy practices carefully before providing Personal Information to such third parties.

You are knowingly and voluntarily assuming all risks of using any third-party websites, services, or applications. You agree that we shall have no liability whatsoever with respect to such third-party sites and your usage of them.

7. THIRD-PARTY TRACKING TECHNOLOGIES

When you visit or access our Services, we use (and authorize third parties to use) web beacons, cookies, pixels, scripts, tags, and other technologies (the "Tracking Technologies").

The Tracking Technologies allow us to automatically collect information about you and your online behaviour, as well as your device (for example your computer or mobile device), for different purposes, such as to enhance your navigation on our Services, improve our Services’ performance and customize your experience on our Services. We also use this information to collect statistics about the usage of our Services, perform analytics, deliver content which is tailored to your interests and administer services to our Users, advertisers, publishers, customers, and partners.

We also allow third parties to collect information about you through Tracking Technologies.

Cookies are small files, typically of letters and numbers, downloaded onto your computer or mobile device when you visit certain websites. Generally, we use first-party and third-party cookies for the following purposes:

  • to make our Services function properly.
  • to provide a secure browsing experience during your use of our Services.
  • to collect passive information about your use of our Services.
  • to help us improve our Services.
  • to remember your preferences for your convenience.

We use the following types of cookies on our Services:

  • Strictly Necessary Cookies. These cookies are essential because they enable you to move around and use our Services. For example, strictly necessary cookies allow you to access secure areas on our Services. Without these cookies, some services cannot be provided. These cookies do not gather information about you for marketing purposes. This category of cookies is essential for our Services to work and they cannot be disabled.
  • Functional Cookies. We use functional cookies to remember your choices so we can tailor our Services to provide you with enhanced features and personalized content. For example, these cookies can be used to remember your name or preferences on our Services. We do not use functional cookies to target you with online marketing. While these cookies can be disabled, this may result in less functionality during your use of our Services.
  • Performance or Analytic Cookies. These cookies collect anonymous passive information about how you use our Services, including webpages you visit, and links you click. We use the information collected by such cookies to improve and optimize our Services. We do not use these cookies to target you with online marketing. You can disable these cookies.
  • Third-Party Cookies. These are cookies that are provided by third-party service providers and belong in one of the cookie categories described above. These third-party providers process your Personal Information on our behalf pursuant to our instructions and obligations consistent with this Privacy Policy.

Depending on whether you would like to manage a first-party or third-party cookie, you will need to take the following steps:

  • First-Party Cookies. You can enable, disable, or delete our cookies through the browser you are using to access our Services. To do this, follow the instructions provided by your browser (usually located within the "Help", "Tools" or "Edit" settings). Please note, if you set your browser to disable cookies, you may not be able to access secure areas of our Services, and/or parts of the Services may not work properly for you.
  • Third-Party Cookies. Modern browsers also allow you to block third-party cookies using the steps described above.

8. YOUR RIGHTS

You may contact us at any time by email (at: DPO@livelisteners.com), and request:

8.1. To access or be informed about any Personal Information related to you

You can request a copy of your own Personal Information that Livelisteners currently stores. Once we receive and confirm your verifiable request, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting that personal information.
  • The categories of third parties with whom we shared that personal information.
  • The specific pieces of personal information we collected about you.
  • If we disclosed your personal information for a business purpose and identifying the personal information categories that each category of recipient obtained.

We will comply with your data access request without undue delay and in any event within one month after receiving such request. This period may be extended by two more months where necessary, depending on the complexity and number of the requests. If we cannot comply with your request within this time frame, before expiring this period, we will inform you by notice in writing about the reasons why we are so unable. As soon as practicable, after the expiration of that period, we will fully comply with your request or comply to the extent we are able to. Also, the response we provide will also explain the reasons we cannot comply with a request, if applicable. The copy of your Personal Information will be supplied by reference to the data at the time when the request was received. We will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your request unless it is excessive (for example, because you requested a copy of your data numerous times in a short period), repetitive, or manifestly unfounded. If we determine that the request warrants a reasonable fee (considering the administrative costs for providing you the information), we will tell you why we made that decision and provide you with a cost estimate before completing your request.

If, for any reason, we do not act on your request, we will inform you without delay and at the latest within one month of receipt of the request of the reasons for not taking action and on the possibility of lodging a complaint with a supervisory authority and seeking a judicial remedy.

8.2. To change or update any Personal Information related to you

For example, if you believe that your Personal Information is incorrect, you may ask to have it corrected or deleted. Note that you may also request that we will correct errors with regard to your Personal Information (except in cases where the information is required to be kept in its original format under any applicable laws and regulations). We will comply with your update data request without undue delay and in any event within one month after receiving such request. If we cannot comply with your request within this time frame, before expiring this period, we will inform you by notice in writing about the reasons why we are so unable. As soon as practicable, after the expiration of that period, we will fully comply with your request or comply to the extent we are able to. Also, the response we provide will also explain the reasons we cannot comply with a request, if applicable. If the data has been disclosed to a third party during the 12 months immediately preceding the day on which the correction is made, we will take all practicable steps to supply the third party with a copy of the data as so corrected accompanied by a notice in writing stating the reasons for the correction. Also, we will select a format to provide your personal information that is readily useable and should allow you or the third party to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your request.

8.3. To request deletion of your account and associated Personal Information

You have the right to request that Livelisteners deletes any of your personal information that we collected about you and retained. Once we receive your request and verify who you are, we will delete (and direct our service providers to delete) your Personal Information from our records without undue delay, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for reasons of public interest in the area of public health, or for us and our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.

8.4. To object

We process your data for a variety of reasons as explained in “WHY DO WE PROCESS YOUR INFORMATION?”. Applicable law may entitle you to require us not to process your Personal Information for certain specific purposes where such processing is based on legitimate interest. If you object to such processing, we will stop processing your personal data for these purposes.

In specific situations, we may have to refuse the execution of your request. This would be the case where we have legitimate grounds to continue such processing or if we must establish, exercise or defend legal claims.

Please keep in mind that objecting to the use of your data might disable the use of your account.

Please note that you may, at any time, ask us to stop sending you marketing emails by opting out in your account settings.

8.5. To restriction of processing

You have the right to request that we hold your Personal Information in “limbo”, while other challenges are resolved. Precisely, you can ask us to put on hold the use of your data in 4 cases:

  • If you contest the fact that the Personal Information we hold about you is accurate. In this case, the processing operations in relation to this data will be put on hold for the period during which this is verified.
  • You have objected to a processing activity based on (a) legitimate interest(s). In this case, you can require the processing operation to be put on hold while we verify the grounds for processing.
  • You consider that the processing is unlawful but you object to erasure and request restriction, instead.
  • We have no further need for the data, but you require it to establish, exercise or defend legal claims.
  • Despite your request, we may continue the processing of your Personal Information if we must establish, exercise, or defend legal claims. We will notify you before lifting a restriction.

8.6. Right to lodge a complaint with a supervisory authority

If you consider that our processing of your Personal Information infringes the GDPR legislation or any other applicable national laws, you have the right to lodge a complaint with a supervisory authority.

Please note that these rights are not absolute, and requests are subject to any applicable legal requirements, including any legal and ethical reporting or document retention obligations. While data privacy is an important right, your interests must be balanced against other important rights or public interest. Exceptions to your rights include:

  • crime prevention or prosecution.
  • security and defence.
  • statistics and research.
  • the use of Personal Information is required or authorised by law or court order or is required for exercising or defending legal rights.

We may also rectify, replenish, or remove incomplete or inaccurate information, at any time and at our own discretion, in accordance with our internal policies.

9. INTELLECTUAL PROPRETY RIGHTS

We respect other people's rights and expect you to do the same. You will not post content or take any action on Livelisteners.com that infringes or violates someone else's rights or otherwise violates the law. We can remove any content or information you post on Livelisteners.com if we believe that it violates this Privacy Policy or the Terms and Conditions. You will not use our copyrights or any confusingly similar marks, without our written permission. If you collect information from our registered Listeners, you will: obtain their consent, make it clear that you (and not Livelisteners.com) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it. You will not post anyone's identification documents or sensitive financial information on Livelisteners.com. You will not tag Livelisteners registered Listeners or send email invitations to non-users without their consent.

10. RETENTION OF PERSONAL INFORMATION

If you have registered an account through our Services, the Company will retain your Personal Information for as long as is necessary for the performance of the contract between you and us and to comply with our legal obligations. In addition, the Company will retain your Personal Data for additional periods, to enable the Company to meet its legal obligations under applicable laws or regulations, Know-Your-Customer and Anti-Money Laundering regulations.

If you no longer want us to use your information, you can request that we erase your personal information and close your account.

Please note that if you request the erasure of your Personal Information, we will retain your personal data for as long as we consider it necessary to:

  • Comply with our legal obligations. For example, we may keep some of your information for tax, legal reporting, and auditing obligations. Please note that according to GDPR legislation, financial related information shall be kept for a period of minimum seven (7) years.
  • Conduct our business and for our legitimate business interests, such as establishing, exercising, or defending legal claims, chargeback prevention, fraud detection and prevention, hindering any other illegal activity on our site, and enhancing safety. For example, if we close or suspend your account for fraud or illegal activities, we may retain certain information about you to prevent you from opening a new account in the future. Such information shall also be kept available in case of ongoing judicial proceedings/and or investigations. As part of our fraud detection and prevention process, we also blacklist all former usernames for a certain time. Therefore, a former username cannot be used for new registration.

Some copies of your information (e.g., log records) may also remain in our database, but are disassociated from personal identifiers. For research and/or statistical purposes, personal data held is anonymised to the extent that we (or anyone else) will not be able to directly or indirectly identify the individuals concerned.

If for any reason you wish to delete your Personal Information, please send us an e-mail to DPO@livelisteners.com, and we will make reasonable efforts to address your request.

11. NONDISCRIMINATION

Livelisteners will only contact you by electronic means (including email) based on our legitimate interests, as permitted by the applicable law and your consent.
